1. Who is responsible for your data

The controller is UTY3 Sàrl, Route du Petit-Moncor 1a, 1752 Villars-sur-Glâne, Switzerland.

This policy applies to our website uty3.ai. It follows the revised Swiss Federal Act on Data Protection (FADP) and, for visitors in the European Union, the GDPR.

2. What data we process and why

We process only the data needed to run the website and to reply to your messages.

  • Visit to the website: IP address, date and time, pages viewed, browser and system (server logs). We use them to provide the website, keep it secure and fix errors.
  • Audience measurement: pages viewed, visit duration, origin. We use them to understand how the website is used and to improve it.
  • Contact form: name, email address, message and any information you add. We use them to reply to your request.
  • Cloudflare bot protection: IP address and technical signals from the browser. We use them to block automated form submissions.
    We do not sell your data and we do not use it for targeted advertising.

3. Contact form

When you fill in the form, the fields you enter are sent to us by email. We use them to reply to your request, and for nothing else.
The form does not store your message in a database on the website: it exists only in our inbox. If you write to us, you consent to our processing the data you send in order to reply.
Do not include sensitive data (health, opinions, a detailed financial situation) in the message, unless it is essential to your request.

4. Audience measurement

We use Google Analytics to measure traffic on the website. It records in particular the pages viewed, visit duration, device type, browser, country or region, and the referring page.

  • Tool with cookies or identifiers: cookies are placed on your device. They are activated only after you agree through the consent banner, which you can withdraw at any time.
    The data is used for statistics, not to identify you personally. You can also prevent tracking by configuring your browser or by enabling “Do Not Track”.

5. Bot protection (Cloudflare)

To block automated submissions, the contact form uses a verification service from Cloudflare, Inc. (101 Townsend St, San Francisco, CA 94107, United States). It replaces the classic captcha: it analyses technical signals from your browser, including your IP address, to tell a person from a bot.
This data is sent to Cloudflare when the form loads and is processed under Cloudflare’s own privacy policy. Our legitimate interest is to protect the website and our mailbox from spam and abuse.

6. Hosting (Infomaniak)

The website is hosted by Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Les Acacias (Geneva), Switzerland. Website data and server logs are stored in Switzerland.
Infomaniak acts as a processor: it processes the data only to provide hosting to us, on our instructions and under a data processing agreement.

7. Transfer of data abroad

Your data stays in Switzerland in principle. Two services may process it abroad:
• Cloudflare (United States), for bot protection.
• Google Analytics (United States), for traffic statistics.
These transfers rely on an adequacy decision (the Swiss-US Data Privacy Framework, where the provider is certified) or, failing that, on standard contractual clauses recognised by the Federal Data Protection and Information Commissioner.

8. How long we keep data

  • Server logs: 90 days, then deletion.
  • Audience measurement data: 18 months at most.
  • Messages received through the form: for as long as it takes to handle your request, then 24 months at most, unless the law requires us to keep them longer (for example if a contract is concluded).
    After these periods, the data is deleted or anonymised.

9. Security

The website is served over HTTPS. Access to the data is limited to the people who need it and to the providers named above. No transmission over the internet is 100% secure, but we take appropriate technical and organisational measures to limit the risks.

10. Your rights

You can ask us at any time:

  • to know what data we hold about you (access);
  • to correct inaccurate data;
  • to delete your data;
  • to restrict or object to processing;
  • to receive your data in a common format (portability);
  • to withdraw a consent you have given, without affecting what happened before.

Write to us at info@uty3.ch. We may ask for proof of identity and we generally reply within 30 days.
If you believe your data is being mishandled, you can lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch. Visitors from the EU can contact the data protection authority in their country.

11. Changes

We may update this policy, for example if we change a tool or if the law changes. The version in force is the one published on this page, with its date at the top.
